Decision of the Ministry of Housing and Urban-Rural Development on Amending the Provisions on the Administration of Qualifications for Construction Enterprises and Other Departmental Rules

(Promulgated by Order No. 45 of the Ministry of Housing and Urban-Rural Development of the People's Republic of China on December 22, 2018, effective as of the date of promulgation)

　　To implement the State Council's requirements for deepening the reform of "streamlining administration, delegating powers, improving regulation and optimizing services" and accelerating the advancement of "one-stop online government services," the Ministry of Housing and Urban-Rural Development decides:

　　1. Article 14 of the Provisions on the Administration of Qualifications for Construction Enterprises (Order No. 22 of the Ministry of Housing and Urban-Rural Development, amended by Order No. 32 of the Ministry of Housing and Urban-Rural Development) is amended to read: "Where an enterprise applies for a construction enterprise qualification, it shall submit the application matter on the website or approval platform of the qualification licensing authority, and submit electronic materials such as those concerning funds, professional and technical personnel, technical equipment and completed performance."

　　2. Article 11 of the Provisions on the Administration of Qualifications for Construction Project Survey and Design (Order No. 160 of the Ministry of Construction, amended by Order No. 24 and Order No. 32 of the Ministry of Housing and Urban-Rural Development) is amended to read: "Where an enterprise applies for an engineering survey or engineering design qualification, it shall submit the application on the official website or approval platform of the qualification licensing authority, and submit electronic materials such as those concerning funds, professional and technical personnel, technical equipment and completed performance." Articles 12 and 13 are deleted, and the order of the relevant articles is adjusted accordingly.

　　3. Article 12 of the Provisions on the Administration of Qualifications for Engineering Supervision Enterprises (Order No. 158 of the Ministry of Construction, amended by Order No. 24 and Order No. 32 of the Ministry of Housing and Urban-Rural Development) is amended to read: "Where an enterprise applies for an engineering supervision enterprise qualification, it shall submit the application matter on the website or approval platform of the qualification licensing authority, and submit electronic materials such as those concerning professional and technical personnel, technical equipment and completed performance."

　　4. Paragraph 1 of Article 6 of the Provisions on the Administration of Qualifications for Real Estate Development Enterprises (Order No. 77 of the Ministry of Construction, amended by Order No. 24 of the Ministry of Housing and Urban-Rural Development) is amended to read: "A newly established real estate development enterprise shall, within 30 days from the date of obtaining its business license, submit the filing matter on the website or platform of the qualification approval department, and submit electronic materials such as its business license, articles of association, qualification certificates of professional and technical personnel and labor contracts."

　　This Decision shall be effective as of the date of promulgation. The above four departmental rules shall be amended accordingly in accordance with this Decision and re-promulgated.
