In order to strengthen the management of fire protection design review and acceptance technical service activities for construction projects, regulate market behavior, and safeguard public safety, the Ministry of Housing and Urban-Rural Development has researched and drafted the "Measures for the Management of Fire Protection Design Review and Acceptance Technical Services for Construction Projects" (Draft for Comments), and recently solicited public comments. The deadline for feedback is February 3, 2024.
The management measures clarify that fire protection design review and acceptance technical services for construction projects (hereinafter referred to as "fire protection review and acceptance technical services") refer to activities providing technical services for fire protection design review, fire protection acceptance, and record-filing spot checks of construction projects (including building construction projects, municipal engineering, and specialized construction projects), including technical review services for fire protection design documents, on-site assessment services for fire protection acceptance, spot check services for fire protection acceptance record-filing, as well as special fire protection design consulting, fire protection inspection services for completion acceptance, and whole-process fire protection technical consulting, etc. These measures apply to engaging in fire protection review and acceptance technical service activities within the territory and to the supervision and management of fire protection review and acceptance technical service units and their practitioners.
The competent departments of housing and urban-rural development are responsible for guiding and supervising fire protection review and acceptance technical service activities and management work nationwide, and the competent departments of housing and urban-rural development of local people's governments at or above the county level are responsible for the supervision and management of fire protection review and acceptance technical service activities within their administrative regions.
The management measures require that fire protection review and acceptance technical service units shall have independent legal personality and also meet multiple practice requirements, such as having technical directors and technical personnel that meet work needs, fixed office premises, and complete equipment, devices, and facilities. In terms of service requirements, they shall carry out fire protection review and acceptance technical service activities in accordance with relevant laws, regulations, and national fire protection technical standards for engineering construction, implement quality control management over their own fire protection review and acceptance technical services, conduct technical review of the opinions or reports issued, and bear comprehensive technical responsibility.
The competent departments for fire protection review and acceptance shall implement dynamic supervision over fire protection review and acceptance technical service activities within their administrative regions and carry out supervisory inspections through methods such as "double random, one open." When implementing supervisory inspections, they shall enter the workplaces of fire protection review and acceptance technical service units to conduct inspections; inquire and investigate relevant situations with fire protection review and acceptance technical service units, commissioning parties, and relevant units and personnel; inspect the professional and technical capabilities of technical personnel; and consult and copy relevant commissioning contracts, service activity data, video materials, issued opinions or reports, and other relevant materials.
