小黄住在丰台一个小区。其父亲说，小黄乘坐由母亲驾驶的轿车驶入自家车位后，坐在副驾驶位置的小黄下车，但由于机电公司维修隔壁升降车位的车库横板，未对周围进行任何安全隔挡及相应警示，导致小黄下车踏空后跌落到车位基坑受伤。经医院诊断为急性闭合性颅脑损伤，多处骨折，住院31天，经鉴定构成九级伤残。小黄起诉要求物业公司、机电公司连带赔偿医疗费等共计23万余元。
法院认为，物业并非施工方，不应承担责任。机电公司在维修机械车位时，未设置明显警示标志，亦未设置护栏等安全措施，致使小黄踏空跌入基坑内，应承担全部赔偿责任，据此作出上述判决。
