The General Office of the State Council recently issued the "Assessment Measures for Ensuring the Payment of Migrant Workers' Wages" (hereinafter referred to as the "Measures"), deciding to conduct annual assessments from 2017 to 2020 on the governments of all provinces (autonomous regions and municipalities) and the Xinjiang Production and Construction Corps regarding their work in ensuring the payment of migrant workers' wages, so as to promote the implementation of territorial supervision responsibilities and effectively safeguard the rights and interests of migrant workers in receiving labor remuneration.
The "Measures" consist of 13 articles, clarifying the subjects and targets of the assessment, the content and procedures of the assessment, the grading and evaluation standards, and the application of assessment results. The assessment work is carried out under the leadership of the State Council, implemented by the Inter-Ministerial Joint Conference on Solving the Problem of Wage Arrears in Enterprises, and specifically organized and implemented by the Office of the Inter-Ministerial Joint Conference.
According to the "Measures", the assessment work should adhere to goal orientation, problem orientation, and result orientation, emphasizing key points and focusing on practical results. The assessment targets are the provincial-level governments. The assessment content mainly includes strengthening organizational leadership for ensuring the payment of migrant workers' wages, establishing and improving wage payment guarantee systems, and the effectiveness of efforts to address wage arrears, especially in the field of engineering construction.
The assessment is divided into three steps. First, provincial self-examination. Each provincial-level government shall, in accordance with the assessment plan and detailed rules, conduct a self-examination of the progress and effectiveness of ensuring the payment of migrant workers' wages in the assessment year, and form a self-examination report to be submitted to the Office of the Inter-Ministerial Joint Conference. Second, on-site verification. The Office of the Inter-Ministerial Joint Conference shall organize member units to form assessment teams, and conduct on-site verification of the provincial self-examination reports by means such as random inspections. Third, comprehensive evaluation. Based on the provincial self-examination reports and combined with on-site verification, the Office of the Inter-Ministerial Joint Conference shall organize member units to conduct assessment and evaluation, and form an assessment report.
The assessment results are divided into three grades: A, B, and C. The assessment results serve as a reference for the comprehensive assessment and evaluation of the leadership teams and relevant leading cadres of each provincial-level government; any issues discovered during the assessment that require accountability shall be transferred to the disciplinary inspection and supervision authorities.
For provincial-level governments with an A-grade assessment result, the Inter-Ministerial Joint Conference shall issue a commendation notice; for provincial-level governments with a C-grade assessment result, the Inter-Ministerial Joint Conference shall conduct a supervisory talk with the relevant responsible persons of the provincial government, requiring them to rectify within a time limit and submit a written report. Those who commit fraud, conceal or make false reports during the assessment work, resulting in inaccurate assessment results, shall be criticized in a notice; if the circumstances are serious, the relevant personnel shall be held accountable in accordance with discipline and law.
